We at Epoch Games strive to provide the very best RPG experience possible, while working closely with our community to achieve the best immersion and visuals known in an Indie-developed game. Our current project, "Lays of Althas: Sundered Order", is a Medieval low-fantasy RPG set in the world of Jevreth, on the continent of Althas.

The Lays of Althas: Sundered Order is a Single-player, first-person, Medieval-Fantasy RPG currently being developed on Epic's Unreal Engine 4, for Windows PCs. The game is currently planned to be released by a Chapter basis, with every Chapter bringing new regional content and planned gameplay features.

Is using another game's concept art illegal? If they didn't use it that is?
What do you mean by this? Is using, but not using another game's concept art illegal? Well, if its not copyrighted then they can't claim it, but its pretty distasteful to do so, copyright or not.

Depends on how distinct it is from the game it was produced for. If it is so similar and distinctly derived from the game's source material, the conceot art is a derivative work and copyrighted. If not, the artist himself would have copyright claims. Copyright is established TECHNICALLY when the material is in a fixed form. But registration helps. Personally, I would find the use of another's concept to produce a new product to be in poor taste.

define 'wasted'. It might not necessarily get shown to the public, but that isn't the point of 'concept art'. Concept art is part of the design process, its not a PR tool. Companies usually create art specifically for PR purposes, and standard concept art is solely used internally for defining atmosphere and drafting designs.
Concept art can't get "wasted". One of the reasons is that sometimes it's basically just an idea of an atmosphere, a style or an emotion. It doesn't always have to be fully implemented in a game.
