The Alaska Supreme Court next assessed whether Alaska tribes retain non-territorial sovereignty that includes original jurisdiction over child custody disputes, given the absence of "Indian country" and the intervening
ANSCA. (90) Carefully reviewing United States Supreme Court precedent, the court concluded that "the nature of tribal sovereignty stems from two intertwined sources: tribal membership and tribal land." (91) The court reasoned that membership-based jurisdiction exists irrespective of a tribal territory (or "Indian country") and includes the power to adjudicate internal child custody disputes.
