BREAKING: Jury sides with Bungie. Says cheat-sellers violated Bungie's copyright and owe the company the profits on their cheats (Bungie had wanted statutory damages and attorneys fees, but those were ruled out before the trial began.) So the jury awards Bungie $63,210 Jury rejects counterclaim about Bungie allegedly illegally obtaining files from one of the defendants' computers. To my knowledge, this is the 1st time a jury (in the U.S., possibly the world) has ruled on a game cheating case. With this, we now have a jury verdict that supports game companies' frequent claims that cheats like these infringe on copyright Phoenix Digital founder David Schaefer tells me his group will fight this, moving to dismiss the verdict and, if that fails, appeal. The dispute here is whether Bungie truly proved a copyright violation occurred. Game companies have been getting default rulings against cheat-makers for years, often with giant, multi-million-dollar awards. But this was the rare case where the cheat-makers pushed back, said their actions weren't illegal and where it was left for a jury to decide https://lnkd.in/esJjYb6V

MOONTON GAMES and Riot Games have resolved their global intellectual property disputes through a recent settlement agreement. On April 2, 2024, following extensive communication, both parties officially signed the agreement, leading Riot Games to withdraw its related lawsuits. The controversy dates back to 2017 when Riot Games filed a $2.9 million lawsuit against MOONTON Games for Copyright Infringement. And it continued since then until now. The resolution between MOONTON Games and Riot Games marks the end of a highly discussed controversy in recent times. At what point does code manipulation, whether intentional or accidental, become detrimental to the owner's intellectual property (IP)? How can such a prevalent issue be effectively regulated? Bungie's recent legal victory has pushed the boundaries further than any previous game-cheating lawsuit in the U.S. court system. While cheating in online games isn't inherently illegal, game companies often rely on the anti-circumvention provisions of the 1998 Digital Millennium Copyright Act (DMCA) to combat it. This approach has been used by the makers of Grand Theft Auto V, Overwatch, Rainbow Six, and Fortnite against cheat developers. Previously, Nintendo has pursued actions against various emulation sites, reflecting its stringent stance against copyright infringement. In the latest legal move, Nintendo targets the Yuzu emulator, accusing it of facilitating piracy by allowing Nintendo Switch games to be played on unauthorized platforms.
