3 | These license terms are an agreement between Microsoft Corporation (or based on where you live, one of

4 | its affiliates) and you. Please read them. They apply to the software named above, which includes the
|
---|
5 | media on which you received it, if any. The terms also apply to any Microsoft
|
---|
6 | * updates,
|
---|
7 | * supplements,
|
---|
8 | * Internet-based services
|
---|
9 | * support services, and
|
---|
10 | * Debugging symbol files that you may access over the internet
|
---|
11 | for this software, unless other terms accompany those items. If so, those terms apply.

12 | By using the software, you accept these terms. If you do not accept them, do not use the
|
---|
13 | software.
|
---|
14 | If you comply with these license terms, you have the rights below.
|
---|
15 | 1. INSTALLATION AND USE RIGHTS. One user may install and use any number of copies of the
|
---|
16 | software on your devices to design, develop, debug and test your programs.
|
---|
17 | 2. ADDITIONAL LICENSING REQUIREMENTS AND/OR USE RIGHTS.
|
---|
18 | a. Distributable Code. The software contains code that you are permitted to distribute in programs
|
---|
19 | you develop if you comply with the terms below.
|
---|
20 | i. Right to Use and Distribute. The code and text files listed below are Distributable Code.
|
---|
21 | * REDIST.TXT Files. You may copy and distribute the object code form of code listed in
|
---|
22 | REDIST.TXT files.
|
---|
23 | * Sample Code. You may modify, copy, and distribute the source and object code form of
|
---|
24 | code marked as sample.
|
---|
25 | * Third Party Distribution. You may permit distributors of your programs to copy and
|
---|
26 | distribute the Distributable Code as part of those programs.
|
---|
27 | ii. Distribution Requirements. For any Distributable Code you distribute, you must
|
---|
28 | * add significant primary functionality to it in your programs;
|
---|
29 | * require distributors and external end users to agree to terms that protect it at least as much
|
---|
30 | as this agreement;
|
---|
31 | * display your valid copyright notice on your programs; and
|
---|
32 | * indemnify, defend, and hold harmless Microsoft from any claims, including attorneys fees,
|
---|
33 | related to the distribution or use of your programs.

---|
34 | iii. Distribution Restrictions. You may not
|
---|
35 | * alter any copyright, trademark or patent notice in the Distributable Code;
|
---|
36 | * distribute any symbol files which you may access or use under these license terms for the
|
---|
37 | software;
|
---|
38 | * use Microsofts trademarks in your programs names or in a way that suggests your
|
---|
39 | programs come from or are endorsed by Microsoft;
|
---|
40 | * distribute Distributable Code to run on a platform other than the Windows platform;
|
---|
41 | * include Distributable Code in malicious, deceptive or unlawful programs; or
|
---|
42 | * modify or distribute the source code of any Distributable Code so that any part of it
|
---|
43 | becomes subject to an Excluded License. An Excluded License is one that requires, as a
|
---|
44 | condition of use, modification or distribution, that
|
---|
45 | * the code be disclosed or distributed in source code form; or
|
---|
46 | * others have the right to modify it.
|
---|
47 | 3. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only gives you some rights
|
---|
48 | to use the software. Microsoft reserves all other rights. Unless applicable law gives you more rights
|
---|
49 | despite this limitation, you may use the software only as expressly permitted in this agreement. In
|
---|
50 | doing so, you must comply with any technical limitations in the software that only allow you to use it in
|
---|
51 | certain ways. You may not
|
---|
52 | * work around any technical limitations in the software;
|
---|
53 | * reverse engineer, decompile or disassemble the software, except and only to the extent that
|
---|
54 | applicable law expressly permits, despite this limitation;
|
---|
55 | * make more copies of the software than specified in this agreement or allowed by applicable law,
|
---|
56 | despite this limitation;
|
---|
57 | * publish the software for others to copy;
|
---|
58 | * rent, lease or lend the software;
|
---|
59 | * transfer the software or this agreement to any third party; or
|
---|
60 | * use the software for commercial software hosting services.
|
---|
61 | 4. INTERNET-BASED SERVICES. Microsoft provides Internet-based services with the software. It may
|
---|
62 | change or cancel them at any time.
|
---|
63 | a. Consent for Internet-Based Services. The software contains features which may connect to
|
---|
64 | Microsoft or service provider computer systems over the Internet. In some cases, you will not
|
---|
65 | receive a separate notice when they connect. You may switch these features on or you may
|
---|
66 | choose not to use them. For more information about these features, see
|
---|
67 | http://www.microsoft.com/info/privacy/default.mspx. By using these features, you consent to the transmission of
|
---|
68 | this information. Microsoft does not use the information to identify or contact you.
|
---|
69 | b. Misuse of Internet-based Services. You may not use these services in any way that could
|
---|
70 | harm them or impair anyone elses use of them. You may not use the services to try to gain
|
---|
71 | unauthorized access to any service, data, account or network by any means.
|
---|

---|
73 | 5. BACKUP COPY. You may make one backup copy of the software. You may use it only to reinstall the
|
---|
74 | software.
|
---|
75 | 6. DOCUMENTATION. Any person that has valid access to your computer or internal network may copy
|
---|
76 | and use the documentation for your internal, reference purposes.
|
---|
77 | 7. EXPORT RESTRICTIONS. The software is subject to United States export laws and regulations. You
|
---|
78 | must comply with all domestic and international export laws and regulations that apply to the software.
|
---|
79 | These laws include restrictions on destinations, end users and end use. For additional information, see
|
---|
80 | www.microsoft.com/exporting.
|
---|
81 | 8. SUPPORT SERVICES. Because this software is as is, we may not provide support services for it.
|
---|
82 | 9. ENTIRE AGREEMENT. This agreement, and the terms for supplements, updates, Internet-based
|
---|
83 | services and support services that you use, are the entire agreement for the software and support
|
---|
84 | services.
|
---|
85 | 10. APPLICABLE LAW.
|
---|
86 | a. United States. If you acquired the software in the United States, Washington state law governs
|
---|
87 | the interpretation of this agreement and applies to claims for breach of it, regardless of conflict of
|
---|
88 | laws principles. The laws of the state where you live govern all other claims, including claims under
|
---|
89 | state consumer protection laws, unfair competition laws, and in tort.
|
---|
90 | b. Outside the United States. If you acquired the software in any other country, the laws of that
|
---|
91 | country apply.
|
---|
92 | 11. LEGAL EFFECT. This agreement describes certain legal rights. You may have other rights under the
|
---|
93 | laws of your country. You may also have rights with respect to the party from whom you acquired the
|
---|
94 | software. This agreement does not change your rights under the laws of your country if the laws of
|
---|
95 | your country do not permit it to do so.
|
---|
96 | 12. DISCLAIMER OF WARRANTY. The software is licensed as-is. You bear the risk of using
|
---|
97 | it. Microsoft gives no express warranties, guarantees or conditions. You may have
|
---|
98 | additional consumer rights under your local laws which this agreement cannot change. To
|
---|
99 | the extent permitted under your local laws, Microsoft excludes the implied warranties of
|
---|
100 | merchantability, fitness for a particular purpose and non-infringement.
|
---|
101 | 13. LIMITATION ON AND EXCLUSION OF REMEDIES AND DAMAGES. You can recover from
|
---|
102 | Microsoft and its suppliers only direct damages up to U.S. $5.00. You cannot recover any
|
---|
103 | other damages, including consequential, lost profits, special, indirect or incidental
|
---|
104 | damages.
|
---|
105 | This limitation applies to
|
---|
106 | * anything related to the software, services, content (including code) on third party Internet sites, or
|
---|
107 | third party programs; and
|
---|
108 | * claims for breach of contract, breach of warranty, guarantee or condition, strict liability, negligence,
|
---|
109 | or other tort to the extent permitted by applicable law.
|
---|
110 | It also applies even if Microsoft knew or should have known about the possibility of the damages. The
|
---|
111 | above limitation or exclusion may not apply to you because your country may not allow the exclusion or
|
---|
112 | limitation of incidental, consequential or other damages.
|
---|
113 | Please note: As this software is distributed in Quebec, Canada, some of the clauses in this
|

114 | agreement are provided below in French.
