X Consumer Health Data Privacy Policy

This notice describes how X’s Privacy Policy applies to personal data defined as “consumer health data” subject to the Washington State My Health My Data Act (MHMDA) which went into effect as of March 31, 2024 and other similar U.S. State laws.

1. Consumer Health Information We Collect

The scope of consumer health data may be defined more broadly in some jurisdictions than others. As described in the Information We Collect section of our Privacy Policy, some of these categories may be considered consumer health data under the MHMDA and other similar U.S. State laws. Depending on your privacy settings examples may include:

  • Content that includes information about your past, present, or future physical or mental health status that you send to specific X users, such as through Direct Messages or protected posts.

  • Based on your consent, biometric information for safety, security, and identification purposes.

  • If you have enabled precise location on the X mobile app or if you choose to share your location in your profile and posts that could potentially indicate your attempt to seek health-related services.  

  • Other information that may be used to infer or derive consumer health data as defined under the MHMDA.

2. How We Use Consumer Health Information

We may use consumer health data as described in the How We Use Information section of our Privacy Policy. For additional details about how to exercise your rights under the MHMDA, please see the Take Control section of our Privacy Policy and the Exercising Your Rights section below.

3. Sharing Consumer Health Information

We may share each of the categories of consumer health data described above for the purposes described in the Sharing Information section of our Privacy Policy, including:

  • When you post and share; 

  • With third parties & with third-party integrations; 

  • When required by law, to prevent harm, or in the public interest;

  • With our Affiliates; or

  • As a result of a change in ownership.

4. Exercising Your Rights
